Implement the Most Rigorous Environmental Rule of Law to Provide Guarantee for Ecological Civilization Construction

环境保护是生态文明建设的主阵地和根本措施,应当优先实行最严密的环境法治。法治的基础在于立法,本文从环境立法的视角,依据最严密的环境法治的三大特征,分析理解最严密的环境法治内涵和外延,并针对我国环境法治的现状,提出实行最严密的法治的初步思考,以期为建立健全我国生态文明制度体系提供政策参考和决策依据。研究认为:首先落实生态文明理念,构建最严密的法律框架。调整立法理念,修正立法结构,完善立法内容;其次抓住关键环节,实行最严密的法律制度。明确环境质量改善的立法目标,实行最严格的环境准入制度,构建最严密的环境监管机制,建立最严格的责任追究制度;再者强化公众环境权,构建最严密的权益保障机制。进一步加强环境信息公开和完善公众参与机制以及强化公众监督权。

Environmental protection is the main position of ecological civilization construction and fundamental measures, shall give priority to the most rigorous environment of the rule of law. The basis of the rule of law is the law, this paper from the perspective of environmental legislation, according to the most rigorous environment three major characteristics of the rule of law, analysis and understand the most rigorous environment connotation and denotation of rule of law, and environment of the rule of law in our country, puts forward a preliminary thinking of the rule of law in the most rigorous, in order to provide policy reference and decision - making basis for improvement of the system of ecological civilization in China. Research suggests that ： first, to carry out the concept of ecological civilization, to the most rigorous legal framework. Adjust the legislative idea, the revised legislation structure, perfect the legislation content; second, to seize the key link, practice the strict legal system, to definite target in environmental quality improvement of legislation, the strictest environmental access system, build the most strict environmental regulation mechanism, establish the strict responsibility system; further, to strengthen the public environmental rights, build the tightest of rights and interests safeguard mechanism. To further strengthen environmental information disclosure and improve the public participation mechanism, and strengthen the public supervision.
