中国式农地征收补偿的困境及其出路探寻——基于法条及实践的观察

十八大以来,农地征收在诸多农村问题中的地位尤为凸显。城市化进程中的中国农地征收补偿,身陷公共利益界定不清,所有权主体多元,征地补偿标准滞后,补偿范围狭隘,安置方式单一,解纷机制堵塞等诸多困境当中;对其针对性一一提出解决方案,目的在于为时下正在热议中的《农村集体土地征收补偿条例》的制定建言献策。

Since the 18th Congress of the CPC, land expropriation plays a more important role in many rural areas problems. The problems of China＇s land expropriation compensation, including the public interest is not clearly defined, ownership is multivariate, compensation standard lagged, compensation scope narrow, placement method single, the dispute resolution mechanism blocked and many other difficulties. Solutions are proposed one by one. The aim is to give advice and suggestions about ＂the Ordinance on expropriation compensation of rural collective land＂ which is being discussed now.
