控告检察新增职能研究

On the New Procuratorial Functions of Complaints Departments

修改后的《刑事诉讼法》第47条、第115条,赋予了检察机关控告申诉部门办理阻碍辩护人、诉讼代理人依法行使诉讼权利行为的控告申诉,以及检察机关依法监督司法机关及其工作人员违法办案的职责。履行新职能需要检察机关正确理解立法本意,分析控告申诉检察工作面临的新挑战,在实践中积极探索应对思路和方法。

The article 47 and article 115 of the amended criminal procedure law add two functions for the complaints department of the procuratorate. One is handling the charges or complaints from the defenders and agents ad litem whose litigation rights have been hampered, the other is handling the charges or complaints for the illegal actions of judicial or- gans and personnel. To perform new functions, we need to understand the legislative intention, analyze the new challenges against to complaints departments, and actively explore the countermeasures and methods in practice.
