论我国中小微企业科技创新资金法律保障机制的完善

资金是困扰中小微企业科技创新的瓶颈,借鉴科技发达国家经验,强化法律保障机制是解决中小微企业科技创新资金瓶颈的有效手段。我国虽然通过了《中华人民共和国中小企业促进法》、《中华人民共和国科学技术进步法》、《关于支持中小企业技术创新的若干政策》、《关于进一步支持小型微型企业健康发展的意见》等法律和政策文件,但中小微企业科技创新法律保障机制方面仍然存在法律位阶不高、操作性差、缺乏多元化资金融资渠道、融资信用担保体系无法律保障等问题。应该从提高法律位阶、增加具体而有操作性的规定、拓宽融资渠道、设立统一规范的担保机构等方面加以完善。

Funds is the bottleneck for the science and technology innovation of small and medium-sized enterprise. Using the experience of developed countries for reference and strengthening the legal safeguard mechanism are important for them to solve the problem of the science and technology innovation for the small and medium-sized enterprise. Our country has already passed some laws and policy documents, such as SME Promotion Law of the People＇s Republic of China, and Progress of Science and Technology of the People＇s Republic of China, Some Policies to Support Technological Innovation of Small and Medium-sized Enterprises and On Further Supporting the Healthy Development of Small Miniature Enterprise Views, but the small and medium-sized enterprise still has some problems like low legal position, poor operation, lack of diversified financing channels and no legal security of financing credit guarantee system. We should improve the legal level, increase the concrete and operational regulations, to broaden the financing channels and to improve the establishment of unified standards guarantee institutions of the science and technology innovation mechanism for the small and medium-sized enterprise.
