摘要
长期以来,中国实行人事管理和企业管理两套不同的劳动制度。由于具有行政体制特点,高校教师聘任人事关系的法律适用可谓政出多门,导致法律适用的无以适从。就法律性质来说,高校聘任关系与劳动合同具有一定的共性,可以一定程度地适用《劳动合同法》来调整。但是,高校等事业单位毕竟与企业不同,其劳动关系也存在差异性。今后,可以在借鉴《劳动合同法》聘任制度的基础上,结合高校等事业单位聘任制的特点,制定适合其自身特点的聘任关系方面的法律制度。
Personnel management and business management are two labor systems being practiced in China for long. The employment relationship for college teachers is managed by many offices due to the administrative character of higher education institution so that the legal application is complex and empty. This employment is in common with labor contract legally, which may indicate the use of "Labor Contract Law" ;however,colleges and universities are different from other business entities, where the labor relationship is different. It is suggested to take "Labor Contract Law" as a reference and make a more feasible law for this institution alone.
