根据《老年人权益保障法》的规定,居家养老仍然是我国今后一个时期的主要养老方式。但居家养老却面临赡养主体独生子女化的现实。在独生子女作为赡养人的家庭结构背景下,赡养人配偶的赡养义务、赡养权人有多个义务人时的义务履行顺序、赡养义务人有多个权利人时其义务的履行顺序等问题需要重新考量。

According to ＆quot;Elderly Protection Law＆quot;, home care for a time in China is still a major way of supporting the elderly .But home care is facing the reality of the only child supporting entity .In the fami-ly structure of only child as dependents , the following issues need to rethink：the support obligation of the supporter ’ s spouse;the order of fulfilling the obligation when there are more than one obligors;and the order of fulfilling the obligation when there are more than one obligees .
