Tradition and modernization of Chinese marriage and Family Law

婚姻家庭法作为“私法”的重要组成部分与每位公民的生活息息相关。它在适用上具有极大的广泛性 ,在内容上具有鲜明的伦理性和强烈的民族传统特色。现行婚姻法存在诸多缺陷和若干立法上的空白 ,建立亲属制度、无效婚姻制度 ,改善夫妻人身和财产关系以及离婚制度、扩大亲子关系及其他家庭关系的法律调整等 ,应成为婚姻法修改的重点。婚姻法的修改将改变中国婚姻家庭法在传统与现代化中间停滞的不良状态 。

The Marriage and Family Law is a very important part of \!private law\' which is closely connected with everybody\'s life. This paper explores the object, nature and character of the Marriage and Family Law, analyzes the stagnant situation and the reasons for the stagnation of the development of the law in its transformation from tradition to modernization, and advances a specific structure for modernizing the Chinese Marriage and Family Law.
