摘要
唐君毅"法律意识层级"说将法律意识分为畏罚的守法意识、自觉的守法意识、自觉的立法意识、自觉的议法意识和含礼的法律意识五个层级。这一"层级"说将含礼的法律意识等同于法治意识,视"礼治"为"法治"的最高目标,表现出了它在当代中国特色法治视角下的局限性,其实质是一种道德学说。
According to Tang Junyi＇ s Legal Consciousness Level theory, legal consciousness can be divided into five levels： ＇ abiding by the law out of fear of punishment level＇ ＇ consciously abiding by the law level＇ ＇ self-awared legis- lative consciousness level＇ ＇ consciousness to participate in the enactment of law level＇ and ＇ legal awareness out of virtue level＇. This theory, by equating virtue with legal awareness and viewing ＇ rule of rites＇ as the highest pursuit of the rule of law, shows the limitation of being a moral doctrine under the legal system with Chinese characteristics.
