商品房买卖纠纷中质量不合约定的法律适用——对最高人民法院司法解释若干条文的理解

摘要 商品房质量约定为合格的,必须是所有分部分项工程合格,否则即为不符合约定。除非另有约定,对质量不合格分部分项工程返工整改不能免除、抵消出卖人承担减少价款的违约麦汪。影响主体结构安全和整体使用功能的不合格分部分项工程,不能约定免除返工整改。质量不符合约定,买受人主张按差价减少价款并返还的应予支持。可以约定减轻或免除出卖人对标的物各类瑕疵的担保责任。质量瑕疵不是质量不合格。涉及心共利益的质量瑕疵买卖双方不能约定免除。除表面瑕疵外,出卖人告知标的物瑕疵应通过合同形式且应列举。出卖人承担是否告知瑕疵和基本效用显著降低的举证责任。 If the quality of commercial housing contracts for qualified, it must be all part of the project qualified. Otherwise, it is non-conforming. It is ought to supported that buyers claim to reduce and return price differences. Unless otherwise agreed, the rework rectification on the unqualified part of project can not exempt or offset the liability for breach of contracts that sellers bear the price reduction. About the unqualified part of project on the effect of the main structural safety and the overall use of function, both sides cannot agree to dispense the rework rectification. But both sides can agree to reduce or waive the sellers' obligation under bond about each of the subject matter defects. The quality defect is not unqualified. About the quality defects involving the public interests, both buyers and sellers cannot agree to dispense the related liability. In addition to the surface defects, sellers should inform the subject matter defects through the form of contracts and list. Sellers bear the burden of proof about whether to inform the defects and the basic utility significantly reduced.
