关于转包与违法分包工程的法律问题

本文拟对转包及违法分包建设工程诉讼及仲裁实务中的法律问题进行梳理和分析。包括转包建设工程的形态与法律效力，分包序列、劳务分包的性质，以及转包和违法分包建设工程合同纠纷案件的诉讼及仲裁实务观点。

This paper sorted out and analyzed the legal issues about construction litigation and arbitration practice of subcontracting and illegal subpackage. It included morphology and legal effect of subcontracting and the nature of subcontracting sequence and labor subcontracting as well as litigation and arbitration practice view about construction project contract disputes of subcontracting and illegal subpackage project.
