仲裁司法审查实践中的共识?——2012年申请撤销北京仲裁委员会裁决之民事裁定的实证分析

人民法院在对撤销仲裁裁决申请进行审查的过程中，除了严格遵循相关规定外，还应了解仲裁的具体实践，尊重仲裁的特性和规律，北京市第二中级人民法院堪称这方面的表率。通过对2012年北京市第二中级人民法院审理撤销北京仲裁委员会仲裁裁决案件的分析可以发现，人民法院与仲裁机构之间能够在很多方面达成共识。这些共识反过来对仲裁案件的审理提供指引，亦可供其他人民法院在审查当事人的撤销仲裁裁决申请时参考和借鉴。

During the process of reviewing applications on revocation of awards, people＇s courts should comply with law provisions, master the practice and recognize the characteristics of arbitration. In this respect, Beijing No. 2 Intermediate People＇s Court sets a good example. By analyzing orders about applications on revocation of awardsin the year of 2012, we could find that there are many consensus between people＇s courts and arbitration commissions. consensus could provide guidance other people＇s courts＇ reference.
