DNA技术以其独特的科学性、准确性和唯一性,在刑事侦查案件中证据的甄别、犯罪嫌疑人身份的确认以及案件串并等方面提供了科学的、强有力的技术支撑,已经成为刑事侦查破案不可或缺的重要侦查技术手段,被广大刑侦技术人员称为"杀手锏"。但DNA技术在充分发挥积极作用的同时也带来了一些负面影响及道德伦理问题,尤其在DNA的使用中,有可能侵犯个人的基因隐私权,使受害者身心受到极大侵害。能否正确使用DNA技术,充分发挥其积极因素,消除其不利影响,已成为当今社会面临的一项紧迫又现实的问题。因此,如何用辩证的观点看待DNA技术在刑事侦查中带来的利与弊,积极完善DNA技术规范性和立法性,使DNA技术能够更好为刑事侦查和社会治安服务,是当前刑事技术侦查工作亟待解决的课题。本文从哲学视角剖析和研究DNA技术在刑事侦查中的应用,努力为DNA技术更好服务于刑事侦查和社会作有益探索。

DNA technology has played an important role in the detection of criminal eases,provides a strong technical support for solving crimes,and has made great contributions to the society. But it has also some negative influences to the society,including special technical ethics and moral ethics problems. This article analyzes and studies the emergence and development of DNA technology from the perspective of philosophy,reflects its social impacts,absorbs some of its methodological enlightenments dialectically. The article will put forward the thought and method to solve the problem on the basis of the discoveU of these problems,to maximize positive functions and eliminate negative influences,Eventually the paper will provide theoretical basis for the application of DNA technology to criminal investigation and the society.
