摘要
劳动者具有经济和社会二重属性,这决定着劳动者一方面作为劳动力的所有者而存在,另一方面作为社会成员而存在。就业保护制度的设立是劳动者经济权利与社会权利冲突的结果,意味着劳动力市场建设的目标是追求效率与平等、灵活性与安全性之间的某种平衡。劳动力市场的改革与完善必须建立在维护劳动者经济权益的基础上,最低程度地降低就业保护带来的负面效应。
Workers have economic and social attributes,which determine workers as lahor force owners and society members.The establishment of employment protection institution is the result of conflict between labor economic rights and social rights,which means the construction of labor market is the maintenance of a balance between efficiency and equality, flexibility and security. The reform and improvement of the labor market must aim to protect the economic rights and interests of laborers and reduce the negative impact brought on by the employment protection.
