浅谈行政处罚裁量权基准编制与执行中的问题及对策

The Formation of the Discretionary Standards of Administrative Penalties and Countermeasures to the Problems in the Execution

湖南省现有行政裁量权基准的编制和执行中存在着一些问题,主要原因在于省级行政法规的有些规定过于刚性、执法经济作崇以及执法人员的素质参差不齐。建议通过编制《湖南省行政处罚自由裁量权基准汇编》等措施,进一步规范行政执法行为。

There exist such problems in the formation and execution of Hunan’s present administrative stan-dards of discretion as too inflexible regulations ,haunts in economical legal execution and uneven quality of the of-ficials .So this paper suggests that A Collection of Hunan’s Free Discretionary Standards of Administrative Penal-ties be formed to further standardize the administrative law enforcement .
