“三网融合”中的版权侵权问题——以交互式网络电视(IPTV)为例

On the Issues of Copyright Infringement in the Three Network Integration Taking the Internet Protocol TV as Example

"三网融合"对现行版权法律制度形成了新的挑战。解决的最佳方案是做好著作权财产权体系的顶层设计,对各种类型的"传播权"进行整合;次佳的方案是继续维持"信息网络传播权"和"广播权"分立的立法样态,但需要修补各自的"漏洞"。无论哪种方案,都必须有相应的权利限制,这一点在当今"三网融合"、"三屏合一"的环境下显得尤其重要。

The three network integration is a new challenge to the legal system of the existed copyright. The best way is to make up the top design in the system of authorship and property rights and make the integration of all kinds of communi- cation rights,and the second way is continuously to maintain the separated legislation state of the information and network communication rights and broadcasting rights whose loophole （vulnerability） needs respectively to be repaired. And it is necessary to make some corresponding restriction to those rights whatever the solution adopted. This viewpoint is of great importance especially in the present environment of three network integration and three screen unity.
