摘要
教育法制建设的价值取向是权力主体基于一定价值标准做出的价值判断。教育法制建设价值取向包括三个方面:教育立法的价值取向,教育司法的价值取向与教育法律文化建设的价值取向。目前我国教育立法存在"重效率、轻公平""重秩序、轻自由""重实体、轻程序"的价值取向偏失,司法价值取向模糊,尚未形成有利于教育法运行的教育法律文化建设的价值取向。在未来教育法制建设中,必须及时矫正教育立法的价值取向偏失,明确教育司法价值取向并建立以"维权"为核心的教育法律文化建设价值取向,从而完善我国教育法制建设的价值取向,进一步引导教育法律发展。
Value orientation in educational legal construction is a value judgment made by the power subject based on a certain value standards, which include three aspects: the value orientation in educational legislation, the value orientation in educational judicature, the value orientation in construction of the culture of educational law. Nowadays, certain extents of value deviation may still exist in the educational legislation, such as, "efficiency first", "order first" and "lack of procedurally protection". And the value orientation in educational judicature is still not confirmed, the value orientation in construction of the culture of educational law is not available to the operation of the law. Therefore, an eligible value orientation in the educational legislation needs to be establisbed, a specific value orientation in the educational judicature must be founded, and "rights protection" as a core of culture of law must be formed, in order to persevere with the improvement of the educational legal system and to achieve the state of "rule by good law" in China.
