摘要
目前我国灵活就业群体生育保险制度缺位,其根源在于忽视边缘就业群体的社会需求、对生育保险制度的功能认识不足以及立法中缺乏"利益相关者"民主参与的程序和社会性别视角。我国应该在借鉴国外和国内试点城市经验的基础上,结合灵活就业群体的特点,分类构建灵活就业群体的生育保险制度供其选择,修改享有生育保险待遇条件,并给予灵活就业群体医疗和收入双重保障。
At present, the maternity insurance system for flexible employment groups is lack in China, whose roots lie in the neglect of edge employment groups" social demands, insufficient under- standing of the maternity insurance system functions, lack of "stakeholders" democratic participation in the legislation program and the social gender discrimination. Our country should use foreign and domestic pilot cities" experiences for reference, combine with the characteristics of the flexible employ- ment, establish an appropriate maternity insurance system for flexible employment groups, change the conditions to enjoy birth insurance, and build double security systems of medical and income for flexi- ble employment groups.
