刖刑的理性考评

Rational Evaluation of Yue Penalty

刖刑就是采用残酷手段强行将人体下肢的某一部分截断的刑罚。刖刑从产生到被废除,经历了一个逐步轻缓化的过程。这种由严酷走向轻缓的过程,既和西周统治者的"明德慎罚"思想密切相关,也与战国时期新兴地主阶级的"耕战"政策密切相关。废除刖刑是中国古代刑罚由野蛮走向文明的重要标志,值得深思。

To abolish the crimi- nal penalties is an important symbol of the ancient Chinese civilization changing from barbaric to civilization, which is worth considering.
