在现行法层面解读食品安全犯罪的规定,通过与国外相关立法例的横向比较,对我国食品犯罪问题进行定性分析,进一步指出我国食品安全犯罪规定中关于食品安全犯罪的行为对象、主观罪过心理形态以及刑罚结构的不足之处,提出改进意见,以探讨我国食品安全问题的刑法解决之策。

The paper interpreters food safety crime in the current law level requirements, by comparison with the lateral foreign - related legislations on China＇ s food crime qualitative analysis, the paper further points out the in- adequacies in the behavior objects, subjective criminal psychology morphology and the penalty structure of the crim- inal provisions of the food safety crimes, proposes improvements to explore solutions policy on food safety issues by the Criminal Code.
