摘要
搜索引擎只是信息链接通道,不能甄别网络上信息的合法性,原则上无需对因利用搜索引擎而传播的侵权信息承担侵权责任。但就竞价排名服务而言,搜索引擎相当于广告发布者,要承担广告发布者的审核责任。由于其技术特点,又与传统广告媒体侵权责任判断标准不同。
Search engine need not assume the tort liability for the dissemination of illegal infringement information a- rising from the use of search engine, because Search engine is only a channel linking to information, which can not screen legitimacy of information on the network. But, in terms of Bidding Rank service, search engine must under- take the advertisement publishers audit responsibility, for Search engine is equivalent to the advertiser. Because of its technical characteristics and difference to the traditional advertising media, search engine tort liability has differ- ent judgment standard.
