摘要
就民事、行政交叉案件而言,涉及房屋权属变更登记的诉讼可能是出现频率最高的案件。在此类案件的审理过程中,善意取得对于诉讼方式的选择存在着影响,诉讼过程中如果涉及对善意取得的认定问题,应该在行政诉讼中一并解决,而不应采取"民事先行"的诉讼模式,即以善意取得属于"基础民事法律关系"为由中止行政诉讼,告知当事人通过民事诉讼途径解决善意取得的认定问题。对善意第三人利益的保护使得房屋权属变更登记行政诉讼的判决形式具有特殊性。同时,善意取得制度对于合理界定登记机构的审查义务也具有启示作用。
For the civil and administrative cross cases, the litigation involving change of housing ownership registra- tion may be the cases which appears in highest frequency. In the proceedings in such cases, acquired in good faith system has impact on the choice of litigation form, if'there is the issue of authorization acquired in good faith in liti- gation process, it should he addressed in the administrative proceedings, and the "civil ahead" rule should not be taken. Protection of the interests of third parties makes the administrative litigation judgments form of housing own- ership registration change turn unique.
