试论司法公正及其保障之策

Expound the Jurisdiction Justice and the Guarantee Measures

任何一个社会问题 ,决不是一个孤立的社会现象。司法公正也并非一个单纯的法律过程 ,就“司法公正”谈“司法公正” ,难以解决非“司法公正”自身所存在的问题。应运用联系的观点 ,从法哲学的多维视角对司法公正的积极性及其保障进行探索 ,要从深层角度揭示要求司法公正的基本动因。司法公正是市场经济和民主政治要求的必然。司法公正应坚持市场经济条件下的社会效益这一总原则。保障司法公正 ,应着力构筑营造好外部 (体制、立法和监督 )

Any society problem is not an isolated society phenomenon. Jurisdiction justice is not a simple law course, either just say “jurisdiction justice” on “jurisdiction justice”, the question that lies in “jurisdiction justice” itself is difficult to solve. It should use the viewpoint of integration to explore the positivity and guarantee of jurisdiction justice by the many-sided angles of view, and reveal the basic reason of demanding jurisdiction justice by the deep angle. Jurisdiction justice is the necessity of market economy and democratic politis demanding. Jurisdiction justice should stick to the general principles of society benefit in the condition of market economy. The guarantee of jurisdiction justice should take great pains to build well the outside supervision mechanism, the organization, the legislation, and the supervision, to restrict the activity of jurisdiction.
