各国都在探索环境保护创新机制,普遍认为应当更多地采用市场激励手段。排污权交易制度是一种典型的市场手段,将经济行为的外部性内部化,对于转变经济生产方式,改善生态环境质量,具有重大而深远的意义。主要从法律的角度对我国排污权交易存在的制度缺陷进行分析,并针对性地提出在我国现有国情下如何完善排污权交易法律体系,培育排污权交易市场,最终以求环境风险合理分散、社会稳定和谐之目的。

Many countries are exploring innovative mechanisms for environmental protection, and generally having the con- sensus that market incentives must be taken to protect environment. Emissions trading is a typical market -based instru- ment, which makes the external economic behavior towards internalization. It will change the mode of economic production and improve the ecological environment quality, playing a significant and far - reaching significances. This article primarily from a legal point of view, analyzes the deficiencies in emissions trading. The ultimate goal is to improve the emissions tradin~ legal system and reach the purpose of make social stability and harmony.
