摘要
民间借贷合约的不完全性与高履约率这个矛盾现象的背后是合约的内在履约机制在起连结作用。把合约的履约过程分为筛选、签约、监督与惩罚4个部分,以合约的特点作为铺垫,继而引出其内在履约机制:在合约筛选阶段主要是信息和信任机制;在合约签约与监督阶段主要是灵活的担保机制;在合约的惩罚阶段主要是非法律的惩罚机制。
The reason for the paradox of incomplete and higher fulfillment rate of private lending contract is the in- herent fulfillment mechanism of the contract. The process of the fulfillment is divided into four parts in this paper： screening, contracting, supervision and punishment. Based on the characteristics of contract as bedding, and then leads to its inherent fulfillment mechanism ： screening phase of the contract is information and trust mechanism ; con- tracting and supervision phase is flexible guarantee mechanism;punishment phase is penalty mechanism based on il- legal mechamism.
