知识产权质押担保是化解科技型中小企业融资难的有效举措。尽管《担保法》和《物权法》为知识产权质押融资提供了法律依据,但由于内在制度尚未统一,外在环境支撑不力,我国现阶段知识产权质押融资发展无法满足科技型企业的实际需要。因此,进一步梳理知识产权质押融资存在的问题,构建良好的知识产权质押融资环境具有重要的现实意义。

Intellectual property pledge guarantees are effective initiatives to resolve high-tech ShiEs＇ financing difficulties. Although the guarantee law and the real rights law provide a legal basis for intellectual property, our current stage of intellectual property pledge loan development still cannot meet the actual needs of the science and technology enterprise due to the internal system has not yet been consolidated and external environment support has been weak. Therefore, further sorting out problems existing in the intellectual property pledge loan and building a favourable environment intellectual property pledge loan has important practical significance.
