目前指导我国未成年人刑事司法运作的仅仅是一些为数不多的司法解释、通知、意见和刑事政策,只是在现有成人刑法理论框架之下附带研究未成年人问题,这对未成年人权益保护十分不利。国外在关于未成年人保护问题上已形成一整套系统完整值得我们借鉴的体系制度。今后应结合未成年人的特点加快未成年人刑事立法进程,构建完整的未成年人法律体系,并着力完善我国未成年人刑事诉讼制度,同时在全国范围内建立少年法院,打造职业化的未成年人司法队伍。

The direct operation of juvenile criminal justice in our country is just some of the few judicial interpretation, notice, opinions and criminal policy. Just studying juvenile problems under the existing adult criminal law theory framework is not good for the rights and interests of juveniles. Foreign countries have formed a complete set of system about protecting juvenile which is worth using. In the future the process of juvenile criminal legislation should be accelerated according to the characteristics of juveniles, a complete legal system of juveniles should be built,our country juvenile criminal lawsuit system should be perfected, a juvenile court should be established,and the professional juvenile judicial team across the county at the same time should be built.
