县级政府依法行政的动力探究:困境、机制与建议

Dynamic of County-level Government's Administration According to Law: Dilemma,Mechanism and Recommendations

近年来,我国依法行政已取得一定成效,但县级政府在依法行政意识、基础、奖惩、人员素质等方面仍存在一些问题,影响了整个依法行政的实施进展。造成这种现实困境的关键性缘由是其依法行政动力不足。笔者从县级政府与依法行政的内在关联入手,认为依法行政的动力构成为利益型动力和内压型动力。以动力作用机制为突破口,提出提升县级政府依法行政动力作用对策及建议:深植理念、改进评估和实践机理。

In recent years, Chinese legal administration has made some achievements, but there are still some problems in awareness, infrastructure, incentive, personnel＇ s quality of the administration according to law, in the level of county government, which affect the whole progress of implementation of administration according to law. The key reason resulting in this dilemma is the lack of power of administration according to law. According to inter - relevancy between the county government and administration by law, the author thinks that the constitution of dy- namic in the administration by law is the dynamic of interest and the internal pressure. Finally, the author makes dynamical mechanism accomplish breach, and proposes three measures to enhance the role of county government le- gal administration： to deeply implant philosophy , to improve the assessment and to practice mechanism.
