试论著作权合理使用的法律价值

On the Legal Value of Fair Use of Copyright

任何创作都可能借鉴已有相关作品的成果,著作权的合理使用制度是在权衡涉及著作权各方利益的前提下的制度安排。在新的形势下,我国《著作权法》关于著作权合理使用制度的规定也面临全新的挑战,通过对著作权合理使用制度的利益关系和社会价值进行分析,以期对新形势下著作权合理使用制度的安排提出建设性的思考。

Existing related works can be used for reference by any creation. The fair use system of the copyright is a system made after weighing the interests of all parties of work right. In the new situation, The reasonable use system of copyright in ＂Copyright law＂ will be challenged. Through analysis about the benefit relations and the social value of the fair use system of the copyright, the author hopes to give some constructive thinking on it under new situation.
