我国公众信息获取权利实现的障碍及保障机制研究

Study on the Obstacle Factors and the Guarantee Mechanism for the Public Right to Access Information in China

论文分析目前我国公众信息获取权利保障面临的障碍因素,针对这些障碍因素,提出构建一套公众信息获取权利保障机制,主要由"应有—法定"的权利转化机制和"法定—现实"的权利转化机制两部分构成,以期保障公众的信息获取权利真正得以实现。

This paper analyses the obstacle factors of guaranteeing the right of the public to access information. In view of the obstacle factors, it proposes to construct a set of guarantee mechanism of the public＇s right to access information, mainly constituted by the two-part namely the ＂clue-legal＂ right conversion mechanism and the ＂legal-actual＂ right conversion mechanism, in order to truly realize the protection of the public right to access information.
