摘要
为了维护社会经济秩序和保护承租人的利益,承租权突破了债权的相对性,租赁物在租赁期间发生所有权变动时,不影响租赁合同的效力,买受人受其约束。该规定有着严格的适用条件,买卖等行为须发生在没有瑕疵的租赁行为有效期内。当承租权与其他权利竞合时,以权利发生的先后确定是否适用"买卖不破租赁"原则。该原则在实践中出现了被滥用的问题,为减少纠纷,保护交易安全,建议立法上应建立"登记对抗主义"的租赁公示制度。
To maintain the social and economic order and protect the interests of the lessee, the creditor's rights break through the rela- tivity of debt. When the ownership of the lease item changes, the validity of the leasing contract is not affected, and the buyer is bound by it. This provision has strict applicable conditions. The trading behavior should occur during the lease period without any defect. When the concurrence of right to rent and mortgage, etc. appears, whether to apply the principle of business'not breaking the lease is determined by action time. The principle is abused in practice. In order to reduce disputes and protect the safety Of transactions, the legislation should establish the lease publicity system of "registration confrontation doctrine".
