摘要
欧盟体育转播权营销反垄断审查的法律依据是《欧共体条约》第81条;市场界定是进行其反垄断审查的第一步;其反垄断审查的主要内容是:联合销售协议、长期的排他性合同和联合购买协议;审查中存在的问题是它们存在限制竞争的行为;解决这些问题的根本办法是将体育的特殊性在公约中进行规定。
The legal basis of the antitrust examination of marketing rights of sports broadcasting rights is Article 81 of European Community Treaty. The first step of the review is define what market is, focusing on joint marketing agreement, long--term exclusive contracts and joint purchasing agreements. Problems caused by the examination is the limitation on competition. Its solution lies in the inclusion of of regulation of sports in the convention.
