台江县苗族婚姻习俗与强奸罪冲突问题调查与思考

Marriage Customs of Miao Taijiang and Rape Conflict Investigation and Thought

未成年人性犯罪问题越来越受到国家和社会的关注,而未成年人犯强奸罪作为一种严重的性犯罪,是要受到刑法的严厉罚处的。文章作者走访了黔东南台江苗族地区,调查当地苗族未成年人犯强奸罪的案例,不难看出许多未成年的强奸案件是发生在婚姻传统习俗的"游方"中或者早婚中,与幼女发生性行为而导致犯罪。从对案例的分析可以看出当地未成年人强奸案有其特殊性。文章以文化为视角,准确"度量"出国家刑法和苗族婚姻习俗在处理此类犯罪案件时需要的"必要的张力"。

The minor crime problem more and more nationaland social concern, but not adult rape as a serious crime, is severely sentenced by the criminal law. In this paper, the author visited Qiandongnan Taijiang Miao area,investigation of the local Miao a juvenile commits the crime of rape case, it is not difficult to see that many minorcases of rape in marriage, is a traditional custom＂ wandering＂ or early marriage, sexual behavior causesand young girl. From the analysis of the case, can beseen in the local juvenile rape has its particularity. From cultural perspective, accurate ＂metric＂ national criminal law and the marriage customs in dealing with such crimes＂ essential tension＂.
