Recent development of legislation on protection of cruise vessel passengers in the United States

美国是目前邮轮旅游立法比较完善的国家,其通过《邮轮安全与安保法》《国际邮轮旅客权利法案》等法律规制邮轮承运人,保障邮轮旅客的合法权益。2013年以来,美国相继制定《邮轮旅客保护法》及《邮轮旅客信任法案》等提案,对于邮轮旅客的权利保护作出了更为详尽和细致的规定。中国未来邮轮立法可从旅游、船舶建造技术、行政监管和邮轮旅游合同当事人权责方面借鉴美国邮轮法律制度。

The legislation of the United States on cruise vessel is considerably perfect and the fight and responsibilities of the cruise carrier and the cruise vessel passengers are regulated by The Cruise Vessel Security and Safety Act of 2010 and the Inter- national Cruise Line Passenger Bill of Rights. Since 2013, two new draft bills have been submitted to the Congress and now in consideration, the Cruise Passenger Protection Act and the Cruise Vessel Consumer Confidence Act. These two bills provide more detailed and clearer regulations on the protection of cruise vessel passengers. The American legal system on cruise ves-sel is helpful to the establishment of the Chinese legal system of cruise vessel in the areas of cruise tourism, shipbuilding technology, administrative supervision, rights and responsibilities of the carrier and the passengers.
