分析实证法学的研究对象为实在法。对法律科学性与逻辑自足性的追逐成为这一学派的落脚点。在此观照下,分析实证法学的司法观透露出对规则的恪守以及对发现法律的坚持。这种司法观缘于"应然"与"实然"的界分、实证哲学的影响和功利主义的刺激。对于我们而言,恪守而不是漠视规则,发现而不是创造法律应是司法活动中法官的当选策略。

The research object of the analytic positivist jurisprudence is the positive law. The school goal of the analytic positivist jurisprudence is chasing the scientific and logic self-sufficiency of law. In this context, the judicial view of this school is the observation of rule and the perseverance of finding law. This judicial view comes from the separation of ＂should be＂ and ＂to be＂, the influence of positivism and the stimulation of utili- tarianism. For us, the judicial strategies of observing not ignoring the rule, and finding not creating the law should be the first choice for judger in the judicial activities.
