Research on Rights Protection System of Ecological Migration for Poverty Alleviation in Guizhou

保护扶贫生态移民的合法权益是保障基本人权,协调利益相关者,促进移民可持续发展的需要。作为扶贫生态移民,除了享有宪法和法律赋予的各项权利外,还应享有因迁移而派生的政治权利、财产补偿权、生存发展权及和谐权等权益。通过促进扶贫生态移民立法,建立健全移民参与和申诉制度,建立扶贫生态移民保障机制等一系列措施构建贵州扶贫生态移民的权益保护体系,保障扶贫生态移民的各项权利落到实处。

Legitimate rights and interests protection of ecological migration for poverty alleviation is to protect the basic human rights of migrants, to coordinate stakeholders, to promote the need of sustainable development in migrants. Ecological migration for poverty alleviation, except for enjoying all rights endowed by the constitution and the law, also should be entitled to derivative rights, such as political rights, rights of property compensation, the rights to subsistence and development, rights of harmony and so on. In order to guarantee all rights of ecological migration for poverty alleviation to make into effect, there are a series of meas- ures to construct rights protection system of ecological migration for poverty alleviation. For instance, promoting legislation of eco- logical immigration for poverty alleviation, establishing and improving the migrants participation and appeal system, and establis- hing safeguard mechanism of ecological migration for poverty alleviation so on.
