Legal Consideration of the Household Income Survey Behavior

家计调查行为是一柄双刃剑,一方面其具有公共利益的维护以及福利资源的最大化利用的功能,另一方面也对公众隐私权和行为自由等构成一定的威胁。立法需要充分考虑社会公共利益之保障和个人基本权利之保护等基本要素,并以目的正当性原则、维护人性尊严原则和透明化原则等为指导,对调查主体与监管问题、调查的范围与隐私权保护问题和调查内容之利用与管理问题等作出明确的规制,以最大限度地实现两者的动态平衡。

Household income survey behavior is a double edged sword. On the one hand, it maximizes the function of the maintenance of public interest and welfare resources, on the other hand it also threatens the privacy and freedom of the public.Legislation needs full consideration of the public inter- est to protect fundamental rights and personal protection and other basic elements.It should be guided by 3 principles of purpose legitimacy,safeguarding human dignity and transparency to make clear the issues of investigation subjects,supervision,scope, privacy protection as well as the application of in- vestigation and management issues in order to maximize the dynamic balance between its advantages and disadvantages.
