Role Orientation of Court under Background of Social Management Innovation

随着党和国家"创新社会治理体制"战略部署的提出,人民法院的角色定位将进一步发生变化。这种变化体现在法院在传统职能的基础上,衍生出来一定意义的"公共政策创制"职能。人民法院越来越成为社会治理创新格局中一支重要的力量。从司法的功能看,法院参与推进社会治理创新的立足点是整合司法资源,积极化解社会矛盾。具体说来,法院参与社会治理创新的切入点或路径是构建或完善多元纠纷解决机制。

With the proposal of our party and state's strategic deployment, to strengthen and innovate the social management, there have been some certain changes in the role orientation of the People's Court. These changes are reflected in the Court's new function of institution of public policy, derived from its traditional functions. And the People's Court has increasingly become an important force in the pattern of social management innovation. In the senseofjudicialfunction, theCourt'sfoothold in advancingthesocialmanagementinnovation liesin integrating judicial resources and resolving social contradictions in an active sense. More specifically, the Court's break through pointorpath is to build or improve the multiple dispute settlement mechanism.
