行政协商制度作为"和谐行政法律秩序"建构的基础模式之一,为行政主体与行政相对人搭建起了理性交往与利益博弈的平台,双方以"合意"为基础共同解决行政问题,是对现代行政法理论与实践的继承和发展。行政协商制度旨在提高行政活动认可度,使行政目的在有效实现的同时预防并减少潜在行政纠纷的产生。然而,作为一种全新的制度设计,有必要对其概念、特征、效力、定位等基本问题予以分析,进而为日后的深入研究有所帮助。

As one of the basic modes of constructing ＂Harmonious Administrative Law Order＂,it provides a platform of rational com- munication and a chance of benefit game between administrative organs and private parties,which based on the ＂agreement＂ to solve the problems.Administrative Negotiation System is the succession and development of administrative lawns theory and practice. The aim of the system is to improve the acceptance of administrative activities,to achieve the purposes and prevent and decrease the occurrence of administrative disputes simultaneously.So as a brand new system,it is necessary to clear the fundamental questions such as concept,characteristics,effectiveness,positioning,aims at intensive studying in the future.
