Coherence and Incoherence of the Text of Statutes

在微观的角度上,虽然立法文本的语篇在衔接手段上表现出一些自己独有的特点,但其整体上仍然是连贯的。从宏观上看,立法文本语篇虽然努力地使用一些衔接手段,以维持立法文本语篇在整个篇章上的连贯,但这种努力最终是失败的,立法文本无法在整体上的破碎感增加人们认知困难,使阅读过程中的"认知损耗"增加。立法文本的这种特性使立法文本具有某些超文本的性质。

In the microcosmic sense, the text of statute is coherent although it has its own characteristics in cohesive ties. But in the macroscopic sense, the text of statute is still broken despite those cohesive ties it uses to try to give us an appearance of coherence. This sense of broken pieces makes reading the text of statute cognitively difficult and makes ＂overhead＂ a necessa- ry part of the reading. So the text of statute shares some similarity with hypertext.
