Observation and Refl ection of China's Practice in WTO Dispute Settlement

中国"入世"十余载,在对外贸易迅猛发展的同时,WTO争端案件也呈上升态势,中国应对WTO争端解决的基本态度由谨慎向积极转变。考察中国WTO争端解决实践的基本事实,不难发现中国在"双反"问题、反倾销问题、SPS措施、特保措施、原材料出口措施等问题上既有胜诉,也有败诉,既取得了成绩,也存在着问题,值得总结与反思。

China＇s foreign trade has rapidly developed, and at the same time WTO dispute cases have increased after her WTO accession for more than ten years. China＇s basic attitude in replying WTO dispute settlement has changed from caution to activeness. It is easy to be found that China has won and yet lost, has made achievements and yet problems existed in issues of anti-dumping and countervailing, anti-dumping, SPS measures, special safeguard measures and raw materials export measures, by observing and studying the basic facts in China＇s WTO dispute settlement practice. All these are worth summarizing and introspecting.
