电子商务交易中的诚实信用原则

Honesty in E-commerce Transaction

诚实信用原则作为民法原则中的"帝王条款",在司法实践中起着重要的作用。随着电子商务的蓬勃发展,电子商务市场面临着技术、安全、道德、法律等方面的危机,交易安全问题、电子合同问题、保护消费者权益问题等对诚实信用原则提出了挑战。这对于民事法律原则的解释提出了新的要求,诚实信用原则在电子商务领域的运用需要新的内涵。在以电子商务作为媒介而产生的法律关系中,对于诚实信用原则的解释应当遵循的要义为:适当、实际、协作履行;承担各类附随义务。

Honesty, an ＂imperial term＂ in civil law, plays an important role in judicial practice. With the flour- ishing of E-commerce, some new crises have arisen in term of technology, safety, ethics and law in E-commerce market. Transaction security, electronic contract, protection of consumers＇rights raise the challenge to the princi- ple of honesty. In order to solve these problems, the civil law should provide new interpretation for the principle of honesty in E-commerce. In the law formulated because of the medium of E-commerce, the interpretation of honesty should be based on the following principles： appropriate principle, practical principle, collaborative fulfillment principle, undertaking all types of subordinate obligations principle, etc..
