摘要
运用系统分析和逻辑分析的方法,以专利标准化为视角探讨行业协会促进竞争的功能及其实现条件。专利标准化既可以在多个方面促进竞争,也会产生限制竞争的影响,行业协会可以通过其相关职能的行使,在专利标准化的过程中以及在专利标准的执行过程中促进其中有利于竞争的因素,并防范和制止其对竞争的损害。行业协会在专利标准化中维护竞争的作用有赖于国家法律的保障、行业协会自身的建设和良好的社会氛围。
By using the methods of systematic analysis and logical analysis the article has explored the competition - pro- moting functions of industry associations from the angle of standardization of patents. While restricting competition, stand- ardization of patents may promote competition in many aspects. During the process of patents standardization and the imple- mentation of standardized patents, industry associations may promote competition and restrain the patent holders from hur- ting competition by exercising their relative functions. The realization of the competition - promoting functions of industry associations relies on the legal guarantee, healthy construction of themselves and good social atmosphere.
