云计算的出现极大地推进了信息技术的发展与变革,与此同时,其自身也面临着虚拟复制行为涉嫌侵犯著作权、虚拟实施行为可能侵犯专利权、图形界面商标权保护力度不够,特别是数据迁移中的商业秘密保护困难等知识产权风险。为此,有必要通过完善法律法规、引导自律自治和加强监督监管等措施保障相关各方合法利益,促进云计算产业的健康有序发展。

The cloud computing has promoted the development and transformation of information technology, while it is al- so faced with a lot of risks for infringing intellectual property. For example, virtual copy may infringe the copyright, or vir- tual implement may infringe the patent, and it is difficult to protect similar patterns by trademark, especially user＇s trade se- cret in data move. Therefore, law and regulation should be modified ; self - restraint and autonomy should be guided ; su- pervision and control should be strengthened. In this way, the interest of related sides can be balanced so as to promote the prosperous development of cloud computing industry.
