驳菲律宾对黄岩岛的主权主张——领土取得的国际法视角

Refuting Philippines' s Territorial Claims over Huyan Island——A perspective of territorial acquisition in International Law

菲律宾是一个不择手段地不断进行领土扩张的国家。如果对于其在南海侵犯我国主权和/或主权权利的每一次扩张行为不给予坚决而坚定的批驳和反制,它就会寻机进行下一次扩张。2012年4月黄岩岛现场对峙事件的结束,并不意味着菲律宾侵犯我国黄岩岛主权和/或附近海域主权权利行为的结束。确定菲律宾具有国际法律人格者的日期,厘清菲律宾对黄岩岛提出领土主权主张的最早日期,理顺菲律宾有关不同主张的性质,是分析和研究黄岩岛领土主权问题的核心和关键所在。根据领土取得的国际法理论和实践,菲律宾对我国黄岩岛提出领土主权要求是毫无国际法上的事实和法律根据的强盗行径。

Philippines is a country that has been expanding its territory continuously with all possible unscrupulous methods. For each of its expanding activities that violate the China ＂s territory sovereignty and/or sovereign rights in the South China Sea, if China does not give criticism and/or adopts countering activities in a firm and staunch way, Philippines will seek for any possible opportunity to make a next expansion. Although Huangyan Island （Scarborough Reef） Confrontation Scene of April 2012 has disappeared, it does not mean the end of Philippines＇s violation of the China＇s territory sovereignty over Huangyan Island and/or sovereign rights over the nearing waters. The cores and/or key issues in analyzing and studying the territory sovereignty over Huangyan Island include determining the date on which Philippines was of international legal personality, clarifying the earliest date on which Philippine claimed territorial sovereignty over Huangyan Island, sorting out the nature of the different claims of Philippines. According to the theory on territorial acquisition in international law and the related international practice, the Philippines＇s claims of territorial sovereignty over Huangyan Island against the China＇s existing claim have not any factual and legal basis recognized in international law, and therefore are that of gangsterist.
