摘要
《卡塔赫纳生物安全议定书》与WTO作为最具影响力的环境保护和国际贸易公约,二者存在诸多矛盾和冲突。具体体现为自由贸易与环境保护首要价值选择不同、预防原则和科学原则的适用不同、复审程序、风险评估措施、处理运输包装标识间的差异以及争端解决机制重叠等等。议定书的通过使得停滞不前的多哈回合"贸易与环境关系"和"粮食援助"议题谈判任务更加艰巨,不同利益集团间的对立和矛盾进一步激化。
Cartagena Protocol on Biosafety and WTO as most influential conventions on environmental protection and international trade are controversial with each other. Differences are embodied in the primary value choice for free trade and environmental protection, adoption of precautionary principle and scientific principle, review procedures, risk assessment, processing, transport packaging, dispute settlement mechanism and so on. Protocol makes the stalled Doha negotiation on ＂relationship between trade and environment＂ and ＂food aid＂ more difficult and the conflict between different interest groups more intensified.
