面对社会变迁的压力,成文法应当如何削弱自身的滞后性缺陷呢?在托依布纳"法的自创生理论"下,法律文本中的模糊语词承担了这一功能。在法律文本中,模糊语词的"三值逻辑"是法律系统进行系统际沟通的逻辑前提,"开放性"实现了法律系统在认知上的可沟通性,"符号+处理"结构模式则成为了法律系统自创生的基本模式。具体来说,法律系统的自我整合、进化是通过模糊语词的信息载体功能、信息输入功能和信息输出功能来实现的,同时这些功能保持了法律系统的稳定性。"无罪推定原则"等一般条款内化为法律系统组成部分的过程就是典型的、通过模糊语词实现的自创生过程。

The function of legal vague language includes carrier function, input function and output function. The general provisions, Like ＂the Presumption of innocence＂, is internalized into the legal system. The whole process is a typical autopoietic process,which is achieved through legal vague language.
