《晋书·刑法志》作者考——以唐代辛骥墓志为新证

A Study on the Author of Jin Shu Criminal Annals

《晋书·刑法志》是研究汉魏晋法律制度的重要史料,历来为学界所重视,惜其作者却史载阙如。通过上世纪初出土的《大唐故刑部郎中定州司马辛君墓志铭并序》的碑文记载,结合传世文献详加考证,认为该墓志的志主辛骥,字玄驭,正是《唐会要》记载的《晋书》分撰人之一的刑部员外郎辛邱驭,亦是《晋书·刑法志》的真正作者。

Jin Shu criminal annals ,which is the important historical records of studying the legal system of Wei and Jin dynasties, is always put a high value by the academic circles. However, there is no record who is the author. According to the Xin Xuan-yu＇s epitaph of the Tang dynasty unearthed in the last century, and combining with detailed textual researching the literature handed down, I presume Xin Xuan-yu, who is the owner of the epitaph, is the actual author. He is Xin Bu Yuan Wai lang, named Xin Ji, or Xin Qiu-yu, one of the authors of Jin Shu which is recorded in Tang Huiyao.
