民意影响司法的机制与效果——基于中美差异的比较分析

The Mechanism and Effect of Public Opinion' s Influence on Judicature——An analysis based on the difference between China and America

虽然中美两国对于民意在司法活动中的重要性都给予了充分肯定,但是民意影响司法的实际效果存在较大差异。通过对两国社会中影响司法的民意形态、民意影响司法的方式以及民意影响司法的路径等构成影响机制的主要组成部分及其与影响效果之间关联性的比较分析,可以发现影响机制是决定影响效果的基础因素,影响机制的不同是导致效果差异的直接原因。对中国社会而言,要改善民意影响司法的效果,需要采取多种措施推动即有机制的变革。

Although the importance of public opinion in the judicial activities is fully affirmed by both China and America, there is big difference in the actual effects of public opinion＇s influence. By the comparative analysis of the relevance between the effects and the Mechanism of influence which include the public opinion＇s form that has main effect on judicature, the way and the route that public opinion influence the judicature, we can find out that the mechanism is the basic factor that decides the effect of influence and the difference of mechanism is the direct reason leading to the difference of effect. In this sense, we need to take various measures to promote the reform of mechanism to improve the effect of public opinion＇ s influence on the judicial activities.
