裁判客观性视域下刑法形式解释研究

随着后现代法学的兴起,司法裁判的客观性面临着种种挑战,但是客观性仍有重大意义,学术界也适时提出了拯救客观性的命题。裁判客观性的基本特征要求法律的明确性、行为的可预测性以及排斥法官的主观臆断。折射在刑法解释上,形式解释贯彻罪刑法定原则更彻底,类推解释和扩大解释的边界也更明晰。在解释方法的位阶排序上,形式解释倡导文理解释比实质解释的目的解释论更契合客观性的基本要求。

With the prosperity of post-modern jurisprudence, the objectivity of the law faces enormous challenges , and ultimately academic circle put forward to save it. The basic characteristics of judicial objectivity demands legal certainty, predictability of behavior and the exclusion of subjective judges. Refraction on interpretation in criminal law, formalistic interpretation theory implement the principle of legality. And the boundary of Analogical interpretation and Expand Explanation is more clear. On the interpretation method sorting, Literal rule by formalistic interpretation theory conform to judicial objectivity in a larger sense than the purpose explanation by the substantial interpretation theory.
