摘要
分析地理信息隐私保护的必要性及具体地理空间技术的隐私风险。比较欧盟法与美国法的相关规定,解读《欧盟数据保护指令》对数据处理的规范模式,分析安全港框架下的数据保护原则,重点探讨数据处理、数据转移及敏感数据等问题。通过比较法研究,旨在对我国地理信息市场化的法律制度构建有所启发。
Geographic information system has brought up privacy problems .The United States privacy legal and reg-ulatory framework is introduced in the paper .The differences on privacy legal protection mode between the United States and the European Union are also detailed .The article also describes the function of Safe Harbor Framework in data cross-border transfer .The article designed to serve as reference data to the legal system construction of GIS in our country .
